§ 1 Area of Validity
The following general terms and conditions apply to the business relationship between the hofgarten-apotheke and the client.
§ 2 Contract termination
Offers of the hofgarten-apotheke are subject to change presenting an order to the client to give a quotation in terms of law. The offer is carried out by transmission of the complete filled-out online order form. The order is valid if hofgarten apotheke does not reject the received offer. If the order is larger than the usual amount needed in a household an explicit confirmation by the hofgarten apotheke is necessary.
As an alternative to the ordered product, hofgarten apotheke reserves the right to perform equivalent services in quality and price or refrain from delivering the product or provide any service if the order is not available any more.
§ 3 Delivery, Order, Products and Prices
Hofgarten apotheke exerts itself to dispatch the ordered product to the given postal address within two working days (within Germany). Part deliveries are valid. Thus no additional cost for postage and packing emerge for the purchaser. If it is anticipated that the delivery can not occur within two working days the purchaser will be informed instantly in an appropriate way.
§ 4 Default
The period of delivery is non-binding. Binding periods of delivery require for its validity a written acceptance by the hofgarten-apotheke.
§ 5 Shipping and Handling Costs
The following shipping and handling costs are valid in Germany:
- No shipping and handling costs are provided.
- Delivery abroad require consultation with the pharmacy.
§ 6 Delivery
The delivery is carried out to the given home address of the client or to any other given delivery address.
§ 7 Payment
a) The purchasing price is due by delivery of the product. It consists of the given gross price including contained value-added tax and delivery costs. Packing is also included in the price. Hofgarten-apotheke can only accept payment methods offered within the scope of the order.
Invoice amount will not be charged from your bank account until the ordered goods are dispatched. If the client is in default the pharmacy is entitled to charge late fees to the amount of 3 percentage points referring to the respective base rate of the European Central bank. If hofgarten-apotheke can prove a higher damage due to delay, it is eligible to assert their claim.
b) Payment methods:
In general, we accept the following payment methods:
- Invoice
- Prepayment
- C.O.D. (cash on delivery)
- Debit entry
However, the exclusion of single payment methods is reserved.
Other payment methods cannot be accepted.
c) The total amount given by ordering is payable without any deduction, discounts or offset.
§ 8 Offset
The client is entitled to offsetting only if his/ her counterclaims have become res judicata or explicitly approved in a written form by the hofgarten-apotheke.
§ 9 Reservation of proprietary rights
The delivered commodity to the client remains the property of hofgarten apotheke until the sales contract is completely effective and until all claims of the hofgarten-apotheke towards the client are completely settled.
§10 Information on the right of withdrawal
1. The right of withdrawal:
For those medications or commodity which is not provided at the pharmacy for collection, the following apply:
Any client has the right to revoke his/her statement in writing without stating reasons (e.g. letter, fax or e-mail) within two weeks or by returning the goods. In order to meet the deadline timely mailing or dispatching the commodity shall suffice. The client covers the reconsignment costs if the delivered commodity corresponds to those ordered and if the price does not exceed the amount of 40 Euros or if the client, in case of a higher price of the commodity, which shall be returned at the time of revocation, has not yet performed any consideration or made a contractually agreed part payment. The revocation is addressed to hofgarten-apotheke.
2. Revocation consequences
In case of an effective revocation each party shall return received services; the compensation use (if any) shall be reimbursed. If the client is only able to return the received service in whole or in part or in a bad condition, he/she is obliged to pay compensation. This does not apply if the deterioration of the goods exclusively results from carrying out an examination (as it would have been possible in a store). Besides, the client can avoid the obligation for value replacement by not using it like the owner would and refraining everything what would reduce the value.
§ 11 Right to return
Each client has the right to return the commodity within two weeks after receiving them to hofgarten-apotheke without stating reasons. In this case hofgarten-pharmacy will reimburse the received purchase price. If the returned goods are damaged or converted in some way, the legally permissible amount will be subtracted from the paid purchasing price. The client can avoid this by, if necessary, only checking the function of the commodity without leaving signs of use and returning them in the original packing.
If commodities from a shipment, whose order values are up to 40 Euros in total, are returned, the client has to cover the reconsignment costs provided that the delivered goods correspond to those ordered. Otherwise, the return is free of charge.
§ 12 Data protection
The client is aware of and agrees that his/ her personal data which is necessary for the order transaction is saved on a data carrier considering the Bundesdatenschutz (BDSG) and Teledienstedatenschutzgesetzes (TDDSG) and handled in utmost confidence.
Due to the fact that the delivery of medications or other commodity is carried out by an external suppliers the data of the delivery address and the addressee have to be passed on to this company.
